Why NRIs Need a Power of Attorney
Most NRIs cannot be physically present in India for every stage of a property transaction — site visits, agreement signing, registration, possession. A properly executed POA allows a trusted person to act on your behalf legally.
Types of POA for Property Transactions
General Power of Attorney (GPA)
Grants broad authority to the agent for all property-related actions. Higher risk — the agent can make decisions you did not intend. Not recommended for property transactions.
Special/Specific Power of Attorney (SPA)
Limits authority to one specific transaction (identified property, specific actions). This is the recommended approach for NRI property purchases.

How to Execute POA from Abroad
Step 1: Draft the POA
Engage an Indian property lawyer to draft the SPA. Include: complete property description, specific actions authorized (sign agreement, pay stamp duty, register, take possession), time limit, and the attorney's full details.
Step 2: Consulate Attestation
Visit the Indian Embassy or Consulate in your country of residence. Required documents:
- Draft POA (printed, not signed yet)
- Valid Indian passport
- Visa/residency permit of current country
- Two passport-size photographs
- Consulate fee (varies by country, typically USD 20-50)
Step 3: Sign and Attest
Sign the POA in front of the Consulate officer. The Consulate attests it with their stamp and seal.
Step 4: Send to India for Registration
Courier the attested POA to India. The attorney-holder must register it at the Sub-Registrar's office in the district where the property is located. Registration should happen within 3 months of execution (varies by state).
Countries with Apostille Option
If your country is a Hague Apostille Convention member (US, UK, Canada, Australia, most of Europe), you can get the POA notarized locally, then apostilled by the competent authority (Secretary of State in US, Foreign Office in UK). This is accepted in India as equivalent to Consulate attestation.
Common POA Mistakes
- Giving POA to the broker — never do this. Use family or independent lawyer only
- Using GPA instead of SPA — unnecessarily broad authority
- Not registering the POA in India — unregistered POA cannot be used for property registration
- Expired POA — check validity period before registration date
- Incorrect property description — must match Sale Deed exactly
Revoking a POA
Send a registered revocation letter to the attorney-holder and register the revocation at the same Sub-Registrar where the POA was registered. Notify all parties involved in the transaction.
