Most Important NOCs for Buyers

1. Society/Association NOC (Resale)

Without society NOC, the transfer cannot happen. The society must approve the incoming buyer. Some societies charge a transfer fee (typically ₹25,000-₹5,00,000 depending on city and society).

2. Bank NOC (Mortgaged Property)

If the seller has an active home loan, the bank must issue a NOC confirming the outstanding amount and agreeing to release the mortgage after payment.

3. Income Tax Department NOC

For properties above threshold values, Form 34A must be submitted. The IT Department verifies there are no tax claims on the property.

Can a society refuse NOC for transfer?

A society can refuse NOC only on valid grounds (pending dues, violation of bye-laws). Arbitrary refusal is challengable under cooperative society laws. Get legal advice if NOC is denied.

What if seller's bank doesn't give NOC?

This usually means the seller has not cleared outstanding dues. The bank NOC process can be done at the sub-registrar office simultaneously — buyer's bank pays seller's bank directly.
