TDS on NRI Rental Income

When an NRI rents out property in India, the tenant must deduct TDS at 30% (plus applicable cess) before paying rent. This applies whether the tenant is an individual, company, or any other entity.

Key difference from residents: For resident landlords, TDS on rent is only deducted when monthly rent exceeds Rs 50,000. For NRI landlords, TDS applies on all rental payments regardless of amount.

How to File ITR for Rental Income

  1. Obtain Form 26AS from the Income Tax portal (shows TDS deducted by tenant)
  2. Calculate taxable rental income after deductions
  3. File ITR-2 (applicable for NRIs with property income)
  4. Claim refund of excess TDS
  5. E-verify using Aadhaar OTP or DSC

DTAA Relief for Double Taxation

If your country of residence also taxes worldwide income, you can claim Indian taxes paid as a credit against your home country tax liability under DTAA.

Tenant's TDS Obligations

Your tenant must: obtain TAN (Tax Deduction Account Number), deduct 30% TDS, deposit with government quarterly using Form 27Q, issue Form 16A to you annually.
